Cancellation Policy

All sales are final. Rescheduling is provided, at no cost, if the captain must reschedule the charter due to rain, adverse weather conditions, or mechanical issues. Only the captain can reschedule the charter. Rescheduling is subject to availability. If you are unable to reschedule within the same year, then 50% of the charter will be refunded. Weather Policy

For your comfort and safety, we do not sail in rain or adverse weather conditions which include, but are not limited to, USCG Small Craft Advisories, excessive winds, excessive rain, thunder and lightning storms, and other extreme conditions. If rain or adverse weather conditions are in the forecast, the captain will review the radar 2 hours prior to departure to determine if we can go sailing or if the charter must be rescheduled.

Terms and Conditions

By making a reservation, you and your guests agree to the following Terms and Conditions:
– Maximum 6 passengers allowed onboard including children and infants.
– Service animals are permitted, pets are not.
– Smoking, vaping, open flames, glass, red wine, hard coolers, illegal drugs, sharp objects, weapons, and other pirate accessories are not allowed.
– To protect us from pirates and stowaways, a valid government issued photo ID (passport or US drivers license) matching the credit card used for booking must be provided in order for any passenger to board the vessel. If a valid photo ID is not provided, passengers will not be able to board the vessel, and refund/rescheduling will not be issued.
– Access to the dock is five minutes before the start of your charter. The sailboat casts off the dock approximately five minutes past the scheduled charter time. The sailboat will wait for late arrivals, but the charter will not be rescheduled or refunded.
– Passengers are responsible for their personal items.
– Excessive consumption of alcohol on a sailboat is unsafe. As per NYS Liquor Authority and the US Coast Guard, if passengers become unsafe due to alcohol consumption, the captain is required to limit alcohol service.
– Wearing a USCG approved life jacket is optional but recommended. For passengers 13 years of age and under, New York State law requires them to wear a life jacket. Passengers under the age of 18 must be accompanied by a parent or legal guardian.
– Boating is inherently dangerous and all risks outside the reasonable control of the owners or operators of GSNYC are waived. GSNYC has the right to refuse or terminate passengers GSNYC judges to be unsafe to themselves, other passengers, and/or crew. GSNYC shall not be liable for damages for emotional distress, mental suffering/anguish, psychological injury, or damage to or loss of personal property. GSNYC shall have the benefit of all statues of the United States of America providing for limitation and exoneration from liability. All disputes and matters whatsoever arising under, in connection with or incident to this contract shall be litigated before the United States District Court for the Southern District of New York in Manhattan or before a court located in New York County, New York.
– GSNYC may take photographs or video during the charter, and we may use those photographs or videos on our website and for other promotional purposes.
